These terms govern your use of the FRCS Ortho question bank and related services available at frcsortho.com (the "Service"). The Service is operated by FRCSOrtho.com("we", "us", "our"). By creating an account or continuing to use the Service you agree to these terms. If you do not agree, please stop using the Service.
1. Who may use the Service
You must be at least 18 years old and, if you are signing up on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms. You must provide accurate registration information and keep it up to date.
The Service is an educational revision tool for candidates preparing for the FRCS (Tr & Orth) examinations. It is not medical advice and must not be relied on for the treatment of patients or for any clinical decision.
2. Your account
You are responsible for keeping your login credentials confidential and for all activity that takes place under your account. Accounts are for a single named individual — sharing an account, or sharing access with others, is not permitted. Tell us promptly if you believe your account has been compromised.
3. Licence and acceptable use
Subject to these terms and payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable right to access the Service for your own exam preparation for the duration of your subscription or trial.
You must not:
- use the Service unlawfully, fraudulently, or to send spam;
- copy, scrape, record, republish, resell, or redistribute questions, explanations or any other content from the Service, in whole or in part;
- infringe our intellectual property rights or those of any third party;
- interfere with the security or integrity of the Service, including probing, introducing malware, or circumventing access controls, rate limits or technical restrictions;
- reverse engineer, decompile or attempt to derive the source code of the Service.
4. Intellectual property
We (or our licensors) own the Service and all content within it, including all questions, explanations, references, software, design and branding. Nothing in these terms transfers any ownership to you. Any content you submit — for example question flags or feedback — grants us a licence to host, process and act on it in order to operate and improve the Service.
5. Subscriptions, payment and billing
Subscriptions are billed in advance at the price shown at checkout and renew automatically each billing period until cancelled. You may cancel at any time from your account page; access continues until the end of the period you have already paid for.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Refunds are also covered by our Refund Policy.
Free trials are limited to one per account and provide full access for the stated period. We may withdraw or change trial availability at any time.
6. Availability and warranties
We work hard to keep the Service available and the content accurate, but we do not guarantee that it will be uninterrupted, error-free, or that any particular result will be achieved in your examination. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
7. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, fail to pay, share your account, or present a security or fraud risk. You may stop using the Service and close your account at any time from your account page. On termination your right to use the Service ends; we will delete or anonymise your data in line with our Privacy Notice.
8. Liability
To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the Service is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect or consequential loss, or for loss of profits, data or goodwill. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by law.
You agree to indemnify us against claims arising from your unlawful use of the Service or your breach of these terms.
9. Changes
We may update these terms from time to time. Where changes are material we will give reasonable notice by email or in the app. Continued use after the changes take effect means you accept them.
10. Governing law and contact
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. You may not assign these terms without our consent; we may assign them as part of a merger, acquisition or reorganisation.
